% 09.05.2016 Present writ petition has been filed challenging the notice dated 15th April, 2016 whereby the petitioner has been directed to appear before respondent No.3 for hearing of a pre-grant Opposition filed by respondent No.5. Petitioner also prays for a direction to respondent No.3 to issue hearing notices in all pre-grant oppositions filed in respect of Indian Patent Application No.3658/KOLNP/2009 and to decide them together upon completion of pleadings. Learned senior counsel for petitioner states that today in the morning petitioner has received a call from the Patent office stating that the petitioner's representation dated 21st December, 2015 shall be considered before hearing arguments in the pre-grant opposition filed

by respondent No.5.

Consequently, learned senior counsel for the petitioner wishes to withdraw the present writ petition at this stage. Accordingly, the writ petition is dismissed as withdrawn at this stage with liberty to the petitioner to file a fresh writ petition in case it is aggrieved by the decision of respondent No.3. Order dasti.
