JULY 05, 2018 At this stage, the matter has been taken up afresh as Mr.Vineet Chadha, Advocate, puts in appearance on behalf of the appellant. Learned counsel for the appellant seeks permission to withdraw the appeal with liberty to seek redressal in accordance with law, in view of observations made in the impugned order dated 12.02.2018 of the ADJ-03 (N/W) Rohini Courts passed in CS(OS) No.626/17 observing to the effect that the appropriate and efficacious remedy available to the plaintiff (i.e. the present appellant) is to seek partition of the properties in metes and bounds and the submissions

made on behalf of the appellant, the appeal is dismissed as withdrawn with liberty granted as prayed. All pending applications also stand disposed of.

The earlier date fixed in the matter i.e.20.08.2018 stands cancelled.
