% 16.07.2018 The petition at hand seeks quashing of the criminal complaint case (CC No.987/1/15) registered and pending on the file of the Metropolitan Magistrate for the offence under Section 138 of the Negotiable Instruments Act, 1881 at the instance of the respondent primarily on the ground that the cheque bears date which is not to be believed at all. Learned counsel for the respondent, however, submitted copy of the notice under Section 251 Code of Criminal Procedure which was served on the petitioner on 25.4.2015 wherein it was stated in her defence that she has admitted the fact that cheque in question bears her signatures. In these circumstances, it cannot be said that the case does not require any trial or is wholly unfounded, reserving the contentions of differences raised by the petitioner to be agitated before the trial court, this Court finds no case is made out for proceedings to be quashed. The petition along with the pending applications are dismissed accordingly.
