% 22.01.2016 I.A. No. 24923/2015 (Order 3 Rule 4 CPC) By this application, counsel for the defendant seeks discharge. Along with the application, counsel has annexed copy of the notice sent to the defendant by registered post informing the defendant of the next date fixed in the matter. Despite the said notice, the defendant did not chose to appear either itself or through counsel when the application was listed before the Joint Registrar on 17.12.2015. None appears for the defendant even today. The application is accordingly allowed.

O.A. NO. 374/2015 This chamber appeal has been preferred by the defendant in respect of the order dated 10.07.2015 passed by the learned Joint Registrar whereby

the right of the defendant to file the written statement has been closed. None has appeared for the defendant to argue this application. I do not find any merit in the appeal looking to the conduct of the defendant. Accordingly, the same is dismissed.

CS(OS) No. 786/2015 In view of the notification No.2718/DHC/Orgl. dated 25.11.2015, issued under Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), at the request of the counsels for the parties, the present suit is transferred to the Court of the District Judge, Tis Hazari Courts, for further proceedings before the competent court on 19.04.2016.
