Learned counsel for the parties state that the parties have arrived at a settlement however, learned counsel for the petitioner states that the petition be disposed of only after the settlement has been acted upon. 2.

Once the settlement has been arrived at between the parties, this Court will not act as an execution court to ensure that the parties act upon the settlement as well.

Considering the fact that the Memorandum of Understanding has been entered into between the parties, present petition and application seeking quashing of FIR on merits is dismissed with liberty to the petitioner to file a fresh petition seeking quashing of the FIR on the basis of compromise, with further liberty to revive the present petition in case the respondent No.2 defaults in acting upon the settlement.
