% 27.03.2017 The present application has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in FIR No.586/2016, under Sections 420/467/468/471/20B/34 IPC, Police Station Patel Nagar. It has been informed by the learned APP for the State on the instructions of the Investigating Officer that in the present case a notice under Section 41(A) of the Cr.P.C. is being issued asking the accused to join the investigation and if after the joining of investigation, if need arises then to take the decision to arrest the accused.

In the light of statement made by the learned APP for the State on the instructions of the Investigating Officer, counsel for the petitioner wishes to withdraw the present application to approach the trial court for cancellation of NBW.

Consequently, on the request of the counsel for the petitioner, the present bail application is dismissed as withdrawn. Application bearing Crl.M.A. 4970/2017 is also disposed of. P.S.TEJI, J MARCH 27, 2017 dd
