The respondent is seeking a release of the amount deposited by the petitioner in terms of order dated 3rd October, 2008 on the ground that the writ petition was dismissed in default on 15th February, 2013 and no application for restoration has filed till date. The application is allowed and the amount deposited by the petitioner along with interest accrued thereon be released to the respondent on the undertaking that in the event of the writ petition being restored at a later date, the respondent shall, upon being so ordered, re-deposit the amount within four weeks.

The application is disposed of.
