% 06.08.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is present in Court and has been identified by SI Surinder of police station Begum Pur.

Respondent no.2 submits that he has settled the matter with petitioner of his own free will and without any undue force, pressure or coercion vide Agreement/Settlement Deed dated 18th May, 2018. He further submits that in view of the settlement arrived at between him and petitioner he has no objection in case FIR No. 42/2017 under Sections 427/506/279 IPC registered at police station Begum Pur is quashed. Affidavit of respondent no.2 in this regard is placed on record at pages 13 to 14.

Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
