The petitioner has filed the present petition, inter alia, praying that the respondent's petition - case No.125/18, captioned Gauri v. Davesh Kumar, which is pending before Sh. Manoj Kumar, ADJ 08 (District Central), Tis Hazari Court, be transferred to the Family Court, District Central, Tis Hazari Court, Delhi.

The petitioner has filed a divorce petition being HMA No.5861809/2016, captioned Davesh Kumar v. Gauri, which is currently pending before the Family Court District Central, Tis Hazari Court, Delhi and is now fixed on 19.07.2019.

Undisputedly, some if the issues involved are common, therefore, the present petition is allowed and the case No.125/18, captioned Gauri V. Davesh Kumar, pending before Sh. Manoj Kumar, ADJ 08 (District Central), Tis Hazari Court, is transferred to the Family Court, District

Central, Tis Hazari Court, Delhi.

The parties are directed to appear before the concerned court on 31.05.2019.

Learned counsel appearing for the respondent states that the interest of the mother of the petitioner was also protected in the proceedings inasmuch as FDRs held in the joint name of the petitioner and his mother have been protected. It is clarified that all subsisting orders in this regard shall continue.

The petitioner's mother is not precluded from instituting appropriate action with regard to her claim.

The petition is disposed of.
