The present petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the petitioner for seeking parole for a period of three months. Status report has been filed; it is taken on record. Petitioner's address has been verified and confirmed.

I have heard the learned counsel for the parties and have examined the file. Nominal Roll dated 16.05.2018 reveals that the petitioner was convicted in case FIR No.138/12 under Section 392/395/397/304/120B IPC registered at Police Station Model Town. He was sentenced to under to rigorous imprisonment for eight years with fine `2,000/-. Crl.Appeal 1320/2014 was decided on 12.02.2018 W.P.(CRL) 1640/2018

by this Court. He has already undergone incarceration for four years, nine months and twenty three days besides remission for one year and twenty six days as on 14.05.2018. The petitioner is not a previous convict.

Earlier he has been granted interim bail for ten days i.e. 07.05.2016 to 17.05.2016 and there are no allegations of its misuse. 3.

For the reasons mentioned in the petition, the petitioner is granted three weeks parole from the date of release on his furnishing personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of the Trial Court. After completion of parole period, the petitioner shall surrender before the Jail Superintendent.
