The Appeal under Section 374 CrPC has been filed on behalf of the appellant against the impugned Judgment dated 29.07.2009 and Order on Sentence dated 03.08.2009 in case FIR No. 53/08 under Section 21(b) and under Section 229a) of NDPS Act, registered at Police Station Narcotics Cell, Delhi.

Vide Order dated 03.08.2009, the appellant was convicted for a term of two years and fine of Rs.10,000/- and in default of deposit of fine, he shall to undergo Simple Imprisonment for a term of two months for the offence under Section 21(b) of NDPS Act and was also awarded R.I. for a period of four months for the offence under Section 22(a) of the NDPS Act. 3.

None has appeared on behalf of the appellant since last many dates. 4.

The Appeal is dismissed in default.
