O R D E R

% 22.05.2018 Mr. Amit Bansal, Senior Standing Counsel for the Revenue, Department of Customs states that the impugned order dated 27th April, 2018 is appealable before the Customs, Excise and Service Tax Appellate Tribunal.

Learned counsel for the petitioner in view of the statement submits that he would prefer an appeal before the Tribunal but there is urgency in the matter as the seized goods have been subjected to stringent and onerous conditions under Section 110A of the Customs Act, 1962. He submits that the value of the goods is about Rs.12 lakhs, whereas the condition imposed requires the petitioner to furnish bank guarantee of more than Rs.34 Lakhs

and furnish a bond equal to value of the goods of Rs.67.85 lakhs. Another condition imposed is that the petitioner should not dispute the value and identity of goods.

It will be open to the petitioner to raise the said contentions before the Tribunal. We hope and trust that the Tribunal keeping in view the urgency will give early hearing.

Recording the aforesaid, the writ is dismissed as withdrawn with liberty as prayed for. No costs.
