O R D E R

% 23.11.2017 Petitioner has approached this Court with the relief, as under : "(a) To direct the respondents by way of appropriate writ, direction and/or order, to do the re-weighment of the consignment booked with the Railway vide parcel bill no. A6551102 (VP No.

SE-4445) for Rs.1,09,227/- dated 12.03.2017 i.e. Annexure P-1 and not to impose any penalty, demurrage, wharfage etc. in this regard, in the interest of justice."

On 29.3.2017, this court directed, as follows : "....................................................................................................... ........................................................................................................ In the meantime, petitioners is directed to pay the amounts demanded by the Railways and upon the said payments being made, the goods are directed to be released to the petitioner. However, before releasing the goods, Railways is directed to re-weigh the consignments. The result of reweighment shall be kept in a sealed cover and not disclosed to the petitioner. It is clarified that this order is without

prejudice to the rights and contentions of either of the parties."

In pursuance of the above-said directions, a sealed cover has come to be placed on record in WP(C) 2712/2017 titled BSC Logistics Pvt. Ltd. Vs. Union of India & Ors. and was opened. Mr.

Singh, ld. Sr. Standing Counsel for respondent-Railways states that in compliance of the directions given on 29th March, 2017, the goods were re-weighed and stand released to the petitioner. In view thereof, nothing further survives in the petition and the same is disposed off accordingly.

Pending application, if any, also stand disposed off accordingly.
