O R D E R

% 23.11.2017 A sealed cover in terms of the order dated 27.3.2017 is handed over and sought to be taken on record. It is taken on record and opened.

Petitioner has approached this Court with the relief, as under : "(a) To direct the respondents by way of appropriate writ, direction and/or order, to do the re-weighment of the consignment booked with the Railway vide parcel bill no. A6551101 (VP No. ER 09828) dated 12.03.2017 i.e. Annexure P-3 and not to impose any penalty, demurrage, wharfage etc. in this regard, in the interest of justice."

On 27.3.2017, this court directed, as follows : "....................................................................................................... ........................................................................................................ In the meantime, petitioners are directed to pay the amounts demanded by the Railways and upon the said payments being made, the goods are directed to be released to the respective petitioners. However, before releasing the goods,

Railways is directed to re-weigh the consignments. The result of re-weighment shall be kept in a sealed cover and not disclosed to the petitioners. It is clarified that this order is without prejudice to the rights and contentions of either of the parties."

Today, Mr. Singh, ld. Sr. Standing Counsel for respondentRailways states that in compliance of the directions given on 27th March, 2017, the goods were re-weighed and stand released to the petitioner.

In view thereof, nothing further survives in the petition and the same is disposed off accordingly. Pending application, if any, also stands disposed off accordingly.
