% 28.02.2020 CM APPL.No.1223/2020 This is an application filed by the appellant seeking appropriate direction. It is stated by the learned counsel for the appellant the matter was settled between the parties on 18.12.2018 whereby the appellant was directed to pay an amount of Rs.1.25 cores to the respondent in the following manner; a) Rs.75.00 lacs on or before 31.12.2019 and b) Rs.50.00 lacs on or before 31.12.2020. On 18.12.2018 a cheque of Rs.5.00 lacs was handed over to the respondent towards the part payment of Rs.75.00 lacs and it was encashed. However, later the respondent did not accept the balance of Rs.70.00 lacs hence this application was moved before this Court to deposit the said amount per order dated 14.01.2020. The said amount was directed to be deposited in the name of Registrar General of this Court and the notice was issued to the respondent. The learned
counsel for the respondent says they have already filed a reply to the said application and they are in process to file applications challenging the order dated 18.12.2018. Be that as it may, in this application, a limited prayer was only made to deposit Rs.70.00 lacs before this Court since it was alleged by the learned counsel for the appellant the respondent is not accepting the amount. Since the amount stands deposited, this application has becomes infructuous and is accordingly disposed of. YOGESH KHANNA, J.
