% 20.02.2019 CM APPL. 53166/2018 (condonation of delay) For the reasons stated in the application, the delay of 78 days in filing the short affidavit on behalf of the respondent No.1 - Union of India is condoned.
The application stands disposed of.
W.P.(C) 5557/2018 & CM APPL.21665/2018 (Stay) Considering the fact that vide notification dated 25.10.2018 filed along with the short affidavit of respondent No.1 - Union of India the provisions of Rule 125 H of the Central Motor Vehicle Rules, 1989 have been notified and brought into force w.e.f. 01.01.2019 as is evident from the notification annexed along with the short affidavit, nothing further survives for direction in this petition. Now it is for the Government of NCT of Delhi
to comply with the amended rules and in case any error or petitioners or anyone have any grievance with regard to the manner in which the provision is complied with, it gives a fresh cause of action to the aggrieved person to ventilate his grievance in accordance with law. With the aforesaid liberty the writ petition and pending application are disposed of as now rendered infructuous.
