This Execution First Appeal under Order XXI Rule 58 of the Code of Civil Procedure, 1908 (CPC) impugns the order [dated 23rd February, 2018 in Old Execution No.186/2011 (New Execution No.96987/2016) of the Court of Civil Judge-02 (Central), Delhi] of dismissal of objection preferred by the appellant to the execution sought by the respondent no.1 / decree holder of a decree for recovery of possession of immovable property in his favour.

I have enquired from the counsel for the appellant as to how this First Appeal lies to this Court, the impugned order being of the Civil Judge. 3.

The counsel for the appellant withdraws the appeal with liberty to approach the appropriate Court.
