% 15.02.2019 This petition challenges the order dated 05.12.2017 whereby the application of the petitioner for granting of leave to defend was dismissed and an eviction order was passed.

It is stated by the learned counsel for the respondent the matter is settled between the parties amicably and the petitioner shall vacate the premises and handover its vacant and peaceful possession on or before 20.03.2019. The learned counsel for the respondent has no objection to it. Let the usual undertaking by the petitioner be filed within a week from today.

The petition and pending application, if any, stands disposed of in terms of above.
