Learned counsel for the petitioner states that he has obtained instructions from his client to the effect that he is willing to forego his seniority with respect to his claim for appointment to the post of SI/GD pursuant to the LDCE-2012, subject to the respondents appointing him to the subject post on his clearing the Physical Standard Test (PST), Physical Efficiency Test (PET) and medical examination, conducted in a time bound manner.

A copy of the Signal dated 30.7.2018 has been placed before us, which clearly states that there are eight unfilled vacancies on the post of SI/GD, through LDCE-2012, under the 'SC' category. There is also no dispute about the fact that the petitioner belongs to the 'SC' category and W.P.(C) 5561/2018

therefore if he qualifies the remaining stages of the recruitment, he shall be entitled to one vacancy in the 'SC' category, for the year 2018-19. 3.

Accordingly, the present petition is disposed of with directions issued to the respondents to give a written intimation to the petitioner to appear before the concerned authorities for undergoing the remaining stages of the recruitment, as mentioned in the Signal dated 30.7.2018. If the petitioner is found eligible, he shall be appointed to the post of SI/GD, for the year 2018-19. It is however made clear that the petitioner shall be entitled to all the benefits effective from the date his appointment takes place. 4.
