O R D E R

% 27.05.2016 The appellants' grievance is that their writ petition is pending for more than 4 years. The learned Single Judge merely issued rule and directed its regular hearing. Counsel complains that this order defeats the purpose for approaching the Court to stop encroachment on public space. The Court noticed that the learned Single Judge - by the impugned order has merely issued rule and as such there is no order that affects the appellant's right. Yet, the order has the effect of postponing the final hearing of the writ petition for a considerable period of time.

Learned counsel for the appellants shares that he would not take more than 15 mins in making his statement at the final hearing. It is

open to the appellants to approach the Single Judge with a suitable application for early hearing which may be considered on its merit having due regard to the work load.

Learned counsel seeks liberty to withdraw the writ petition. Dismissed as withdrawn.
