O R D E R

% 28.04.2015 Petitioner is in incarceration for about 5 and a half years and remaining sentence which he has to serve is about four years. His jail conduct is satisfactory.

By this petition, petitioner seeks parole on the ground that he intends to file SLP in the Supreme Court. It is trite law that every convict has a right to pursue legal remedies available to him upto the highest forum by engaging a counsel of his choice. Govt. of NCT of Delhi has declined the request of parole of the petitioner on the ground that there is apprehension of petitioner jumping the parole and indulging himself in similar offence. However, no grounds have been given on which Govt. of NCT of Delhi has formed such opinion. No such apprehension has been mentioned in the status report. As per the nominal

roll, petitioner has no past criminal record. His Delhi address has been verified by the State which is found to be correct. Keeping in mind the totality of the circumstances, it is ordered that petitioner be released on parole for a period of one month from the date of his release, subject to furnishing personal bond in the sum of `10,000/- with one surety in the like amount to the satisfaction of Jail Superintendent. During the parole period petitioner shall not leave the territorial bounds of Delhi and shall report to the SHO of police station Paharganj twice a week, that is, on every Monday and Thursday at 10:00 am. After completion of parole period petitioner shall surrender before the Jail Superintendent. Writ petition is disposed of in the above terms. Dasti.
