Accordingly, the application stands disposed of. I.A. 23456/2015 Present application has been filed under Order 9 Rule 9 CPC for setting aside the order of dismissal in default dated 23rd March, 2015. Keeping in view the averment in the application, the same is allowed subject to payment of cost of Rs. 5,000/- to learned counsel for the defendants within two weeks.

CS(OS) 2224/2013 Since the pecuniary value of the suit property is less than Rs. 2 crores,

the present suit is transferred to the Trial Court. Consequently, list the present suit before the District Judge, Dwarka on 6th December, 2017 for direction. The District Judge, Dwarka is directed to list the case before an appropriate Court.
