After arguments counsel for the appellant took a pass over. After pass over, counsel for the appellant has taken instructions that the appeal be disposed of as not pressed but appellant be given time to vacate the suit premises on or before 31.12.2019, and which is acceptable to the counsel for the respondent, and therefore, this appeal is disposed of as not

pressed but appellant is granted time to vacate the suit premises on or before 31.12.2019 subject of course to clearing all electricity charges, water charges etc as payable for the suit premises till the time the appellant remains in possession of the same.

Let the appellant file an affidavit of undertaking in terms of the present order within a period of one week and on the appellant filing the undertaking and complying with the terms of the same, appellant will have time to vacate the suit premises on or before 31.12.2019.
