% 09.05.2016 After some arguments, learned counsel for the petitioner submits that he will not press the petition on merits provided that the eviction petition be disposed of expeditiously as his apprehension is that the tenant would be delaying the proceedings. This Court notes that leave to defend has been granted in favour of the defendant / tenant; written statement already stands filed.

Counsel for the landlord submits that he shall examine only three witnesses in support of his case. Affidavit by way of evidence of the afore- noted three witnesses be filed within four weeks from today with an advance copy to counsel for the tenant who shall cross examine the witnesses on the following date. Per contra counsel for the tenant is permitted to examine three witnesses. This is specifically noted in view of the defence which has been set up by the tenant. No unnecessary

adjournments shall be granted by the Trial Court. In this background, the Trial Court shall endeavour to expedite the trial and dispose of the matter expeditiously and preferably within an outer limit of 16 months from the date of receipt of this order. For directions list before the Trial Court on 23.05.2016. Petition disposed of.
