O R D E R

% 04.10.2018 The parties have filed applications under Order 23 Rule 1 of the Code of Civil Procedure, 1908 bringing on record their terms of settlement pursuant to which the petitioner in OMP 242/2015 has handed over a demand draft for a sum of Rs. 1,05,12,475 crores (Rupees One Crore Five Lakhs Twelve Thousand Four Hundred and Seventy Five Only) (after deducting TDS) to the counsel for the respondent. The settlement is taken on record and the petitions and applications

are disposed on binding the parties to the terms thereof. In view of the above settlement any inter se claims arising out of the Agreement dated 14.05.2010 shall stand settled between the parties. Incase the petitioner in OMP 242/2015 fails to pay the balance in terms of the settlement, the respondent shall be at liberty to file appropriate proceedings in that regard.
