PATEL, CHIEF JUSTICE (Oral) W.P.(C) 5765/2018 Counsel appearing for the petitioner submitted that in pursuance of the order dated 28.08.2018 passed by this Court in this writ petition, especially as per the direction given in Paragraphs 2 and 3 of this order, a circular dated 04.09.2018 has been issued in continuation of earlier circular dated 27.08.2018. The circular dated 04.09.2018 ensures a transparent and W.P.(C) 5765/2018 Page 1 of 2

consent based counselling for re-admission of failed and re-compartmental students from Classes IX to XII.

In view of the aforesaid circular dated 04.09.2018 issued by the respondents which is in continuation of the earlier circular dated 27.08.2018 and also looking to the fact that as per the prayer in this writ petition, Master Shivam has already been admitted in a Government school in his neighbourhood in Class IX for the Academic Year 2018-19, we see no reason to further monitor the admission of such types of students in this writ petition.

Hence, we dispose of this writ petition with an expectation that the respondents shall carry out their own directions given in the latest circular as stated hereinabove.

With these observations, this writ petition is hereby disposed of. CM APPLs.
