HON'BLE MR. JUSTICE S. RAVINDRA BHAT HON'BLE MS. JUSTICE DEEPA SHARMA

O R D E R

% 24.10.2016 It is stated that during the pendency of the present petition, the adjudication was completed and an order made by the competitive officer, i.e., the Commissioner of Service Tax. Apparently, the petitioner has preferred an appeal to the CESTAT. In these circumstances, the relief claimed, i.e., quashing of the show cause notice does not survive consideration.

Learned counsel seeks liberty to withdraw the writ petition and to urge all issues on merits. Liberty granted. It is open to the petitioner to urge the grounds with respect to the initiation of show cause notice proceedings as well as merits of the adjudication order in the appeal. Writ petition is dismissed as withdrawn in the above terms. S. RAVINDRA BHAT, J DEEPA SHARMA, J OCTOBER 24, 2016/vikas/
