Petitioner's grievance is to sanction not being accorded to prosecute the Station House, SHO, PS, Connaught Place who was on duty from February 16, 2009 to February 21, 2009, Insp.Sunil Kumar and SubInsp.Ravi Kant. None of the three police officers have been impleaded as respondents in the writ petition.

Status report evinces that DD No.6A was registered at PS Connaught Place on May 15, 2009 recording theft in Host Restaurant. SI Ravi Kant was entrusted with the investigation who reached the spot with Ct.Dev Kumar. Rajesh Thakur, Security Guard was found missing. During search Rajesh Thakur was found dead. He had been assaulted. Broken pieces of furniture was found.

Statement of one Mor Singh was recorded.

registered. Investigation was taken over by Insp.Sunil Kumar Singh. On the basis of input petitioner, Sunil Kumar Sharma became a suspect. He was interrogated on February 17, 2009 and February 21, 2009. He broke down during interrogation and made confessional statements. As per status report lot of stolen properties were recovered. Co-petitioner was also apprehended and so were many more. Charge sheet was filed. As per status report, of the 59 witnesses 34 have been examined.

The status report has been filed on November 07, 2014. 4.

Be that as it may, since none appears for the petitioners at the hearing today the writ petition as also the accompanying application are dismissed for non-prosecution.
