% 12.03.2018 After some hearing, the counsel for the petitioner submitted he may be allowed to withdraw the present petition and instead be given liberty to move an appropriate detailed application justifying defaults committed earlier in submitting the list of witnesses or taking steps to produce witnesses. The counsel for the respondents while submitting no objection to such opportunity being given only insisted that trial Court may be called upon to hear him as well giving him opportunity to file reply to such application.
The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. Needless to add, in the event of such application being moved within two weeks, as is the time sought, the respondent/plaintiff of the case will be entitled to file reply and the trial Court will be obliged to hear both parties before passing an order thereupon in accordance with law.
