% 26.08.2015 Learned counsel for the parties- appellants and respondents in both these appeals directed against the same common judgment and order submitted that a comprehensive settlement has been arrived at. A copy of the said settlement dated 24.08.2015 signed by all parties concerned is produced. The said copies are hereby directed to be placed on record in both the appeals FAO(OS) 429/2013 and FAO (OS) 431/2013.

It is submitted that the parties- who are present in Court will be appearing before the learned Single Judge, before whom the application under Order 23 Rule 3 of Code of Civil Procedure would be considered and appropriate orders drawing up the decree made.

As said earlier, the copies of the settlement agreement/deed are hereby taken on record in view of the contents and in view of the statements made, learned counsel for appellants in FAO(OS) 429/2013 and FAO (OS) 431/2013 seeks leave to withdraw the appeals.
