% 27.11.2017 CM No.43068/2017 The file of appeal is taken up on the application moved. The counsel for the first respondent (the claimant) is also present on service of advance copy.
The appeal of the insurance company is dismissed as withdrawn.
By order dated 10.10.2012, the insurance company had been directed to deposit the entire awarded amount with up to date interest with UCO Bank, Delhi High Court Branch, within the period specified and the amount was directed to be kept in fixed deposit receipt.
The amount with accrued interest shall be released to the claimant in terms of the judgment of the Tribunal. If there is any deficiency, the claimant is at liberty to move the Tribunal with
appropriate application.
The statutory amount shall be refunded to the insurance company after proof of the award having been satisfied is shown. The pending applications also do not survive and stand disposed of accordingly.
