The present writ petition filed by an ex-employee of the respondent no.2 assails the Award dated 24.03.2018 passed by the learned Labour Court-V, Dwarka Courts, Delhi in new DID No.1073/16. Under the impugned Award, the claim of the petitioner has been rejected by the Labour Court, after holding that his services having been terminated within the extended period of probation without any stigma being imposed on him squarely fell within the ambit of Section 2 (oo) (bb).

After some arguments, learned counsel for the petitioner, on instructions from the petitioner, submits that the petitioner is willing to amicably resolve his disputes with the respondents in case he is
paid a lump sum compensation of Rs.75,000/- in lieu of his claims against the respondent.

Learned Senior counsel for the respondent no.2 fairly submits that even though there is no infirmity in the impugned award, the respondent no.2, as a way of goodwill gesture, is willing to pay the said sum of Rs.75,000/- to the petitioner.

Accordingly, with the consent of the parties, the writ petition is disposed of by directing the respondent no.2 to pay a sum of Rs.75,000/- to the petitioner within a period of four weeks. Upon receipt of the said amount, the petitioner will have no further surviving claim against the respondents.

Needless to state that it will always be open for the respondents to reconsider the case of the petitioner for fresh appointment, if they so desire.
