% 25.05.2018 CAV No.507/2018 (by the respondent No.1) 1.

Appearance is entered on behalf of the respondent No.1/caveator, who states that a complete set of the paper book has been served on him. 2.

In view of the above, the caveat stands discharged. W.P.(C) 5667/2018 & CM Nos.22077-78/2018 1.

The petitioners seek quashing/setting aside of the order dated 27.03.2018, passed by the Tribunal staying the operation of the order dated 22.03.2018, whereby the respondent no.1 has been prematurely repatriated to his parent department, respondent No.2 herein. W.P.(C) 5667/2018

2.

A perusal of the paper book reveals that the petitioners have already filed an application for vacating the interim order dated 27.03.2018, on which notice was issued by the Tribunal on 23.04.2018, returnable on 31.05.2018.

3.

This being the position, we decline to entertain the present petition. It is for the petitioners to pursue their application, pending before the Tribunal. 4.

The petition is disposed of, alongwith the pending applications. It is, however, directed that if the Tribunal takes up the matter on 31.05.2018, then an endeavour shall be made to hear arguments and dispose of the stay application filed by the respondent No.1 and the miscellaneous application filed by the petitioners for vacation of the stay order.
