IN THE HIGH COURT OF DELHI AT NEW DELHI

Date of Decision: 25.5.2018 + W.P.(C) 5714/2018 EAST DELHI MUNICIPAL CORPORATION Petitioner Through:

Mr. Kumar Rajesh Singh with Ms.

Puram Singh, Advs.

versus VINOD KUMAR KHURANA & ANR Respondent % Through:

None.

CORAM:- HON'BLE MR. JUSTICE RAHV SHAKDHER RAJIV SHAKDHER.

J. rOR AT;> CM Appl. No.22178/2018 1.

Allowed, subject to just exceptions.

W.P.rCI No.5714/2018 & CM Anpl. No.22177/201S 2.

Via this writ petition, the petitioner/EDMC has challenged summons dated 27.4.2018 issued by the National Human Rights Commission. By virtue of the impugned summons, the Commissioner of the petitioner Coi-poration has been directed to make himself available on 29.5.2018 at I \i 1L00A.M.

3.

It appears that this situation came about as terminal benefits of respondent No.l had not been paid.

3.1 It is the stand of the petitioner Corporation that the terminal benefits, which included pension and amounts to be paid towards DGRC, though W.P.(C) No.5714/2018 Pg.lof2 By:AMULYA

sanctioned, could not be remitted to respondent No.l on account of paucity of funds.

In my view, no interference is called for with the impugned summons dated 27.4.2018. The Commissioner should be abie to explain the situation obtaining in the matter to the NHRC.

5.

Writ petition is, accordingly, dismissed.
