% 01.09.2020 The present matter has been taken up for hearing by way of Video Conferencing on account of COVID-19 pandemic. CM APPL.21185/2020 The present application under Section 151 of the Code of Civil Procedure, 1908 has been instituted on behalf of the applicant/petitioner, duly supported by an affidavit of Mr. Rakesh Kumar Singh, Under Secretary, Ministry of Home Affairs, North Block, New Delhi, paying as follows:

"It is, therefore, humbly prayed that on acceptance of instant application this Hon'ble Court may be pleased to allow: (a) The Petitioner to withdraw the Writ petition No. 3296 of 2017 titled 'Union of India versus Jalaj Shrivastava';

(b) Any other such order(s), which this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case.

Mr. Abhay K. Behera, learned counsel accepts notice on behalf of the non-applicant/respondent and fairly does not oppose the application. In view of the foregoing and the fact that since the applicant/petitioner, who is a dominus litis, do not wish to proceed further with the subject writ petition, the present application is allowed. The applicant/petitioner is permitted to withdraw the accompanying writ petition being W.P.(C) No.3296/2017, titled as 'Union of India vs. Jalaj Shrivastava'.

The application is disposed of accordingly.

W.P.(C) 3296/2017 In view of the order passed hereinabove in CM APPL.21185/2020, the present writ petition is dismissed as withdrawn and disposed of accordingly.
