O R D E R

% 01.11.2018 Memorandum of settlement dated 25th October, 2018 signed by the parties has been placed on record.

It is pointed out that there are typographical errors in paragraph 2 of the said memorandum of settlement. The payment in two instalments of Rs.46,25,000/- are due and payable on 15.02.2019 and 31.03.2019 and not on 15.02.2018 and 31.03.2018. The statement is taken on record. Learned counsel for the parties accept and admit that the said memorandum as clarified.

Mr. Babru Bahan Samal, Sr. Accounts Officer of the appellant company is present and states that the appellant company would be bound by the undertaking given.

We also record that the parties will be bound and abide by the

memorandum.

The appellant has handed over the cheque towards first instalment of Rs.46,25,000/- (bearing No.000556 drawn on ICICI, Bhubaneswar Branch, Unit No.3 dated 01.11.2018). With the aforesaid observations, taking the said memorandum and statements made on record, the appeal is disposed of. SANJIV KHANNA, J.
