% 19.07.2017 Copies of two extended Bank Guarantees have already been filed on behalf of respondent.

Sh. Kapil Mathur, Vice President of DBS Bank, New Delhi Branch is present for recording of his statement. However, his statement cannot be recorded today for the reasons that the respondent had initially filed the Bank Guarantee in FAO (OS) No.383/2015.

The file pertaining to aforesaid FAO (OS) No.383/2015 needs to be summoned and the original Bank Guarantees earlier filed on behalf of respondent need to be perused before recording statements with regards to the extended Bank Guarantees.

Therefore, the registry is directed to attach the file pertaining to FAO (OS) No.383/2015 titled "National Highways Authority of India Vs. Hindustan Construction Co.Ltd." alongwith the instant file on the next date. The respondent shall summon the Manager/official of both the banks which have issued extended Bank Guarantees for the next date for recording of their statements.

An authorised representative of the respondent company shall also remain present on the next date for recording his statement. List on 09.08.2017.
