This suit, in accordance with the Office Order dated 24th November, 2015 of Hon'ble the Chief Justice in exercise of powers under Section 4 of the Delhi High Court (Amendment) Act, 2015 was transferred to the Court of the Additional District Judge-03 (N/W), Rohini Courts, Delhi but has been received back for the reason of that Court not having territorial jurisdiction.

Neither the worthy Registrar General in his order dated 21st July, 2016 nor the Registrar (Original) in the order dated 22nd July, 2016 of after the file was so retuned have indicated as to to which District the suit ought to have been transferred.

The Registrar General and the Registrar (Original) to in future ensure that while placing such matters before the Court they record the District to which the suit should be transferred. In the absence thereof the Bench has to devote its judicial to such administrative jobs. CS(OS) No.1748/2009

Mr. V.K. Kocchar, Registrar (Original) is also directed to meet the undersigned in Chamber in this respect.

On perusal of the plaint the relief claimed in the suit is found to be of declaration with respect to the documents executed by the defendants no.1 to 4 in favour of the defendant no.5 and of permanent injunction to restrain the defendant no.5 from dealing with plot no.73/1, Block-II, WHS, Kirti Nagar, New Delhi which fall in District (West), Tis Hazari Courts. 6.

The defendants no.1 to 4 are stated to be residents of Pitampura, New Delhi which falls in District (North-West) Rohini Courts and the defendant no.5 is stated to be resident of Kirti Nagar, New Delhi which as aforesaid falls in District (West), Tis Hazari Courts, Delhi. 7.

The suit is now transferred to the District Judge (West), Tis Hazari Courts, Delhi.

The parties to appear before Additional District Judge / District Judge (West), Tis Hazari Courts, Delhi on 6th September, 2016. RAJIV SAHAI ENDLAW, J AUGUST 10, 2016 'pp'..
