This petition by way of public interest litigation has been filed with a prayer to quash the Cabinet Decision No.2308 dated 24.02.2016 of the Government of NCT of Delhi to provide compassionate appointment to the respondent No.4 herein to a suitable Group-C post in Government of NCT of Delhi contending inter alia that the said decision is arbitrary, illegal apart from being in clear violation of the public policy. 2.

When the matter is taken up today for consideration, it is represented by Sh.Rahul Mehra, the learned Standing Counsel for Govt. of NCT of Delhi, on instructions, that the impugned decision dated 24.02.2016 has not been acted upon since the respondent No.4 did not accept the compassionate appointment offered by Govt. of NCT of Delhi. The said fact has not been disputed by the learned counsel for the petitioner.

In the circumstances, it is not necessary for this Court to enter into the merits of the case and express any opinion on the various grounds raised in the petition.
