% 30.10.2018 Complainant has alleged in the FIR that petitioner was known to her. He offered to sell his DDA Flat No. 292, Ground Floor, Janta Flat, Khirki Village, Malviya Nagar, New Delhi to her in the year 2003. After purchasing the said flat complainant along with her husband started living in the said flat from 2003 onwards.

In the month of July/August, 2012 petitioner came to her along with one Ravinder and offered to get the aforesaid flat converted from lease hold to free hold. He stated that expenses to the tune of `40,000/- were to be incurred. On the pretext of getting the flat converted from lease hold to free hold, petitioner obtained her signatures on some documents written in English. Petitioner also took away original documents by stating that the same were to be submitted with the DDA for the purposes of conversion. He also took `20,000/- from the

husband of complainant. When her husband enquired from the petitioner about the progress of the conversion of flat, petitioner extended flimsy excuses. Ultimately, flat was not converted from lease hold to free hold. Instead, petitioner filed a suit for eviction against complainant claiming himself to be owner of this flat.

Learned APP submits that complainant has provided photocopy of GPA, Will, Possession Letter, Agreement to Sell etc. in respect of the flat in question.

Keeping in mind the serious allegations levelled against the petitioner, in my view, he is not entitled to the concession of anticipatory bail. Bail application is dismissed.
