The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.410/2014 registered under Sections 354/323/341/451/506/34 IPC at PS Shahbad Dairy. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 06.04.2016. The FIR was lodged on 04.04.2014 after a considerable delay. In her initial statement, the prosecutrix did not level any allegation of rape. Only when her statement under Section 164 Cr.P.C. was recorded on 02.06.2014 she implicated the accused for committing rape upon her. 3.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court. 4.

The bail application stands disposed of.
