Learned counsel for the appellant says that since the impugned judgment only rejects the plaint, and the appellant is entitled under Order 7 Rule 13 CPC to file a fresh suit on the same cause of action, by pleading a complete cause of action, appellant will do so and this appeal be disposed of as not pressed for this reason. 3.
