% 21.09.2016 CM 34767/2016 & WP(C) 4187/2016 CM No. 34767/2016 is an application seeking withdrawal of the writ petition in view of the fact that the tender floated on 18.03.2016 has remained unresponsive, as no bids were submitted. However, the learned counsel for the petitioners points out that they may have remedies in respect of contracts arising out of the tender dated 03.04.2013.

Consequently, he submits that while he may be permitted to withdraw this writ petition, liberty may be granted to the petitioners to pursue their remedies in respect of those contracts arising out of tender dated 03.04.2013 in accordance with law.

The application is allowed.

The writ petition stands dismissed as withdrawn with the aforesaid liberty.
