Petitioners seek impleadment of the wife of the complainant, who is also the injured in the subject FIR.

On the oral prayer of the petitioners, the wife of the complainant is impleaded as respondent No.3.
Her affidavit of 'no objection' along with amended memo of parties is taken on record. 3.
Petitioners seek quashing of FIR No.342/2013 under Sections 323/325/341/506/509/34 IPC, Police Station Kanjhawala, based on a settlement.

It is contended that the parties are neighbours. The subject FIR was registered consequent to a quarrel that took place between the CRL.M.C. 3001/2018
parties over construction of an electricity line. 5.
Learned counsel for the petitioners submits that the disputes between the parties have been settled and a Compromise Deed dated 07.12.2017 has been executed between the parties. 6.
Respondent is present in person and is identified by the Investigating Officer. He submits that he has settled all the disputes with the petitioners. He further submits he does not wish to press his complaint any further.

In view of the fact that disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating there from.

In view of the above, the petition is allowed FIR No.342/2013 under Sections 323/325/341/506/509/34 IPC, Police Station Kanjhawala and the consequent proceedings emanating there from are, accordingly quashed.
