% 16.07.2018 The charge sheet has been submitted pursuant to the complaint made in the FIR No.312/2016, P.S. New Friends Colony, involving offence punishable under Section 364A read with Section 34 IPC. Charge has been framed by the trial court against the petitioner and other co-accused.

It may be that there is no evidence indicating the involvement of the petitioner at the time of the victim being abducted but then the argument raised on his behalf that it was not a case of abduction, is not believable per se in view of the overwhelming evidence including the images picked up from the CCTV footage clearly demonstrating that the victim was forcibly taken away. There is evidence available, including the statement of the victim, as to the role of the petitioner, his car having been used for transporting the victim to the house of the sister of the petitioner where the victim was held captive.

In these circumstances, it cannot be said that the allegations against the petitioner are unfounded. Petition for release on bail is dismissed. R.K.GAUBA, J JULY 16, 2018 Bisht
