CUSAA 153/2018 The facts of this case are identical with those in CUSAA 152/2018 (listed today at Item No.12) except that the penalty imposed in the present case upon the appellant was `5 lacs each under Section 112 and 114AA of the Customs Act, 962 whereas, upon the other two

employees were `2 lacs each under each provision. Accordingly, in this appeal the penalty imposed on the appellant is modified; the appellant is directed to pay `2 lacs under each provision as is in the case of other employees.
