versus GOVT OF NCT OF DELHI THR SECRETARY L & B.. Respondent Through Mr.Devansh Bhatnagar, Adv. for Mr.Yeeshu Jain, Adv. for L&B/LAC.

CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 31.05.2018 Vide the present petition, the petitioner has prayed for quashing of order dated 10th November, 2017 vide which his application for allotment of an alternate plot has been rejected by the respondent. On the last date, learned counsel for the petitioner submitted that for the time being the petitioner would be satisfied if the respondent is directed to treat the present writ petition as a representation and pass a reasoned and speaking order on the same by dealing with all the contentions raised therein. In these circumstances, Mr.Jain, learned counsel who had appeared on advance notice for the petitioner had sought time to get instructions. Today Mr.Devansh Bhatnagar, Advocate appears on behalf of the respondent and submits that he has no instructions on this aspect. However, keeping in view the limited prayer made by learned

counsel for the petitioner, I am of the considered view that there is no impediment to the limited prayer made by the petitioner. Accordingly, the present writ petition is disposed of with a direction to the respondent to consider the present writ petition as a representation and pass a reasoned and speaking order on the same within eight weeks.

It is made clear that the aforesaid direction is being passed without prejudice to the rights and contentions of the parties. Needless to say that in case, the petitioner is still aggrieved by the order passed by the respondent, he would be at liberty to take legal recourse as permissible under law.
