% 25.02.2019 Notice could not be issued to respondent no. 4 as process fee was not filed. However, respondent no. 4 has appeared in Court and accepts notice. Respondent nos. 2 and 3 are also present and accept notice. These respondents have been identified by ASI Gajender of police station Mahendra Park.

Respondent nos.2 to 4 submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure or coercion before the Delhi Mediation Centre, Rohini Court on 02.02.2018. They have already received entire settled amount as stipulated in the Settlement Agreement. Respondent nos. 2 to 4 have also returned two post

dated cheques to the petitioner.

Respondent nos. 2 to 4 submit that they have no objection in case FIR No. 403/2017 under Sections 420/406 IPC registered at police station Mahendra Park and the consequent proceedings emanating therefrom are quashed. Affidavits of respondent nos. 2 and 3 to this effect are also on record.

Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 to 4 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
