The appellant/plaintiff is aggrieved by the order dated 31.03.2016 passed by the trial court on an application filed by the respondent No.1 (defendant No.1) under Order VII Rule 11 read with Section 11 and 151 CPC, which was duly allowed by holding that the appellant/plaintiff is barred from filing a suit for declaration and rendition of accounts as the same is barred by res judicata.

After addressing arguments for some time, learned counsel for the appellant seeks leave to withdraw the present appeal while reserving the right of the appellant to seek his remedies as may be available to him in law. 3.

Leave, as prayed for, is granted. The appeal is dismissed as withdrawn alongwith the pending applications.
