CORAM:
HON'BLE MR. JUSTICE R.K.GAUBA
O R D E R
% 21.08.2018 The petitioner is an accused in criminal complaint case (CC No.327713/2016) pending in the court of Special Court (Electricity), instituted by the second respondent. On account of his absence from personal appearance on 15.05.2018, non-bailable warrants (NBWs) were issued against him. He brought the present petition under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) to assail the said order. By order dated 25.05.2018, the execution of the NBWs was stayed, though subject to direction that he would appear before the trial court on each and every date of hearing. The counsel for the petitioner submits and the counsel for the second respondent confirms that the petitioner has since appeared before the trial court.
CRL.M.C. 2917/2018
Needless to add, the petitioner will be obliged to apply for release on bail, his presence to be regulated accordingly in terms of such order in future. He shall be obliged to scrupulously and meticulously appear without fail on the future dates of hearing before the trial court. The NBWs earlier issued stands cancelled.
The petition stands disposed of with these directions. This disposes of pending applications as well. Dasti to both sides.
